ADA General Information

  Who are "Individuals with Disabilities"?

To qualify under the ADA, an individual must match at least one of three descriptions:

  1. A person with a physical or mental impairment that substantially limits one of more of the major life activities

   Major Life Activities include:

Caring for Oneself

Performing Manual Tasks

Walking, Seeing, Hearing, Breathing, 
Speaking, Learning, Working
Courts have added other
activities such as sitting, lifting, etc.

  

  1. A person with a record of such a physical or mental impairment:  e.g., past enrollment in Special Education, mental illness case records/counseling records, medical records, etc.

 

  1. A person who is regarded as having such an impairment:  e.g., a person with burns/scarring may not experience significant impairment of functioning, but as long as someone considers them to be disabled, they are covered under the ADA.
