In 1990, President George Bush signed into law the Americans with Disabilities Act (ADA), the world's first comprehensive civil rights law for people with disabilities. The ADA is a bold and comprehensive mandate intended to eliminate one of the key barriers to independent living in mainstream American life for persons with disabilities: discrimination ( The Americans with Disabilities Act: From Policy to Practice, edited by Jane West ). As discussed in the Americans with Disabilities Act Handbook (U.S. Equal Employment Commission & U.S. Department of Justice, 1991), the principal objective of the ADA has been to remove the barriers preventing qualified individuals from enjoying the same employment opportunities and public services that are available to persons without disabilities. While it does not guarantee equal results, establish quotas, or require preferences favoring individuals with disabilities over those without disabilities, the ADA does mandate that when an individual's disability creates a participatory barrier, it must be determined whether reasonable accommodation(s) could remove the barrier, thereby permitting equal opportunity and access to mainstream American life. |
